We do not sell your personal information to third parties.
5. Consent
We obtain your manifest, free and informed consent before collecting, using or disclosing your personal information, except where permitted by law. This consent is obtained, as applicable, when you submit a form, when you exchange messages with our chatbot, or through the cookie consent banner on the Site.
You may withdraw your consent at any time, subject to legal or contractual restrictions, by contacting us using the information provided in Section 2. Withdrawing your consent may limit our ability to provide certain services to you.
6. Disclosure of your information to third parties
We do not share your personal information for commercial purposes other than those described in this policy. We may, however, disclose your information to the following categories of third parties, acting as service providers, to the extent necessary for the performance of their mandate:
- Our web hosting provider;
- Google (Google Analytics 4, Google Search Console, Google Tag Manager), for audience measurement and Site improvement purposes;
- Meta (Meta Pixel), for advertising and remarketing purposes;
- Our chatbot provider;
- Our external advertising agency and the advertising platforms it uses to manage our campaigns;
- Any government or judicial authority, where required by law.
These third parties are required to protect your personal information in accordance with standards equivalent to those set out under Law 25, to the extent of our reasonable means of oversight.
7. Transfer of personal information outside Quebec
Some of the service providers listed in Section 6, notably Google and Meta, are based in the United States and may process or store your personal information outside Quebec. Before transferring personal information outside Quebec, we take steps to ensure that this information will receive protection considered equivalent to that provided under Quebec law, including through a privacy impact assessment that takes into account, among other things, the legal framework applicable in the destination territory, the contractual security measures in place, and the sensitivity of the information being transferred.
8. Retention and destruction of personal information
We retain your personal information only for as long as necessary to fulfill the purposes for which it was collected, or to comply with our legal obligations. As a general guideline:
- Information submitted through the contact form or the chatbot that does not lead to a business relationship is retained for a maximum period of 24 months following the last contact, after which it is securely destroyed or anonymized;
- Information related to an established business relationship is retained for the duration of that relationship, plus an additional reasonable period as required for legal, accounting or dispute management purposes.
These timeframes are provided as a general guideline and may be adjusted once our internal retention practices are formally documented. We are committed to reviewing this section as our retention processes become formalized.
9. Security measures
We implement reasonable administrative, organizational, technical and physical security measures to protect your personal information against loss, theft, and unauthorized access, disclosure, copying, use or modification, taking into account the sensitivity of the information involved.
10. Cookies and similar technologies
The Site uses cookies and similar technologies to ensure proper functioning, analyze usage and deliver targeted advertising. A cookie consent banner allows you to accept, decline or customize your preferences before any non-essential cookies are placed on your device. You may also manage or disable cookies directly through your browser settings, although doing so may limit certain features of the Site.
11. Your rights
Under Law 25, you have the following rights with respect to your personal information held by Pierrexpert:
- Right of access: obtain confirmation that we hold personal information about you and obtain a copy of it;
- Right of rectification: have inaccurate, incomplete or outdated information corrected;
- Right to withdraw consent: withdraw your consent to the collection, use or disclosure of your information at any time;
- Right to data portability: receive, in a structured, commonly used technological format, the computerized personal information you provided to us, or have it transferred directly to another organization, where permitted by law;
- Right to cease dissemination, de-indexing or re-indexing, in the cases provided for by law.
To exercise any of these rights, contact us using the information provided in Section 2. We will respond to your request within 30 days of receiving it.
12. Decisions based exclusively on automated processing
The chatbot available on the Site is a customer support tool. It does not make any decision that has legal effects on you or significantly affects you based solely on automated processing of your personal information. Any decision related to a project submission or a business relationship is made by a member of our team.
13. Privacy incident management
We have measures in place to detect and address any privacy incident, meaning any unauthorized access, use or disclosure of personal information. In the event of an incident presenting a risk of serious harm, we will notify the Commission d’accès à l’information du Québec (CAI) as well as the affected individuals, in accordance with our legal obligations.
14. Complaints
If you believe your personal information has not been handled in accordance with this policy or applicable law, you may first notify us using the contact information in Section 2. We will handle your complaint diligently.
You also retain the right, at any time, to file a complaint with the Commission d’accès à l’information du Québec (CAI), at www.cai.gouv.qc.ca.
15. Residents of Canada outside Quebec
If you reside elsewhere in Canada than Quebec, notably in Ontario, the collection, use and disclosure of your personal information by Pierrexpert in the course of its commercial activities is also governed by the Personal Information Protection and Electronic Documents Act (PIPEDA), Canada’s federal private-sector privacy law. The principles described in this policy, including collection limited to identified purposes, consent, the right of access and rectification, and security measures, also apply to this information in accordance with PIPEDA.
If you sign up for our commercial electronic communications, for example promotional email follow-ups, we obtain your prior consent and provide an unsubscribe mechanism in every communication, in accordance with Canada’s Anti-Spam Legislation (CASL). You may withdraw this consent at any time using the unsubscribe link provided or by contacting us using the information in Section 2.
16. Users located in the United States
The Site is publicly accessible to residents of the United States. While there is currently no comprehensive federal U.S. privacy law, we commit, for all our U.S. users, to transparently disclose the categories of personal information collected, the purposes of that collection, and the third parties with whom this information may be shared, as described in Sections 3, 4 and 6 of this policy, and not to sell your personal information to third parties.
For users residing in the State of New York, we maintain an information security program comprising reasonable administrative, technical and physical safeguards, and we will notify you and the relevant authorities without unreasonable delay in the event of a security breach likely to cause you harm, in accordance with the New York State Stop Hacks and Improve Electronic Data Security Act (the “SHIELD Act”).
If the law of your state grants you additional rights with respect to your personal information, we will make reasonable efforts to respond to any reasonable request you send us using the contact information in Section 2. The Site does not currently respond to browser “Do Not Track” signals, as there is no uniform technical standard recognized across the industry.
17. Changes to this policy
We may update this policy at any time to reflect changes in our practices or legal obligations. Any changes will be posted on this page along with a revised update date. We encourage you to review this page periodically.
